The District Court of Hamburg had to decide a case in 1998 in which the defendant had put a link on his homepage which led to someone else's homepage that contained offensive allegations about the plaintiff. Without even mentioning TDG, the District Court of Hamburg held the defendant liable for the allegations on the third-party web site on the basis of the link and adjudged the defendant to pay damages, although the homepage of the defendant contained an express disclaimer which said that the respective authors are responsible for their statements. The District Court of Hamburg pointed out that by this disclaimer the defendant had 'not sufficiently dissociated himself from the statement'. This Intro was stolen of a forgotten source. Rita Hayworth lives forever. And I say explicitely, that I do dissociate myself from all statements on the sites, my links are leading to. Also I'm not responsible for my bad English! But in this case I know the responsible teacher... (of course most phrases were product of cut-and-paste anyway)
